Get a Free IndicationFlorida's workers' comp rules trip up more landscape contractors than any other compliance issue. The threshold isn't simply "4 employees" — it depends on what kind of work you do.
The Actual Rule (FL Statute 440)
- Non-construction landscape work (mowing, planting, maintenance): required at 4+ employees, including owners
- Construction-classified work (hardscape, retaining walls, pavers, irrigation tied to drainage): required at 1+ employee
- Sole proprietors doing only maintenance: not required, but can elect coverage
Most landscape companies do both types of work. Once you pour a single concrete footer or install one paver patio, the 1-employee rule kicks in for the entire payroll on that job.
Class Codes Drive the Premium
- 0042 Landscape Gardening — ~$4.50 per $100 of payroll
- 0106 Tree Pruning, Spraying, Repairing — ~$13.00 per $100 (highest in the industry)
- 5183 Plumbing/Irrigation under hardscape — ~$5.80 per $100
- 5022 Masonry / hardscape — ~$11.00 per $100
A $300K payroll booked entirely under 0042 costs ~$13,500/year. The same payroll misclassified to include tree work under 0106 costs $39,000. Audit balance-due bills of $15K–$50K are common.
Exemptions
Corporate officers can file an exemption (limit of 3 officers in construction, no limit in non-construction). Exemptions don't apply to the underlying employees — they just remove the officer from the comp payroll.
File exemptions through the Florida Division of Workers' Compensation portal. They expire every 2 years.
What Triggers an Audit
- Subcontractors without their own comp certificate — their payroll rolls onto yours
- Misclassified tree work
- 1099 workers treated as employees by the auditor
- Payroll growth over 25% mid-policy
How to Lower Premium
- Get a real certificate of insurance from every sub before they start
- Separate tree work into its own LLC if it's >20% of revenue
- Use a PEO for crews under 10 — often 15–25% cheaper than direct-written
- Keep your experience mod (E-Mod) under 1.00 with documented safety training
Penalties for Going Without
Florida's Stop-Work Order is the most punishing in the country: $1,000/day plus 2x the premium you should have paid for the prior 2 years. A $20K/year policy becomes a $40K+ penalty.
